FREEDOM OF INFORMATION ACT REQUESTS FILED WITH THE NEA BY FOUR
MAJOR ARTS ADVOCACY ORGANIZATIONS
On August 11 and August 26, 1994 People for the American Way
and a coalition consisting of the National Campaign for Freedom of
Expression (NCFE), the American Civil Liberties Union (ACLU) Art Censorship
Project and the Center for Constitutional Rights (CCR), co-counsels in
Finley v. NEA, each requested from the National Endowment for the Arts all
documents relating to the fellowship applications of Andres Serrano, Merry
Alpern, and Barbara DeGenevieve and the decision of the National Council of
the Arts of the National Endowment for the Arts to reject those
applications on August 5, 1994, under the Freedom of Information Act
(FOIA), 5 U.S.C. 552 et seq., and implementing agency regulations. People
for the American Way has received a response from the Endowment which has
been posted and copies of all permissible documents are now available by
contacting Aaron Eichorst at People For 202-467-2323; a copy of the letter
from the NEA's FOIA Officer outlining reasons why many of the requested
documents had been withheld has also been posted (AWNEWS Item 470). NCFE's
formal letter of protest to NEA Chair Jane Alexander has also been posted
(AWNEWS Item 472).
NCFE, ACLU and CCF's FOIA request to the Endowment also seeks a
reconsideration of the Council's decision to override panel recommendations
for grants to the three photographers. Based on statements that were made
by various National Council members at the August 5 meeting, they believe
that the decision to deny these grants violated both the NEA's governing
statute and the First Amendment to the U.S. Constitution.

SOUTH DAKOTA ARTS COUNCIL SAFE BUT NOT SECURE
On September 9th, the South Dakota Legislature passed a number of bills
reducing the Fiscal 1995 general and special appropriations by $28 million
and authorizing the use of 7 million additional dollars of the State's
reserve account to replace general fund revenue lost by the closing of
video lottery machines throughout the state in early August. This action
by the Legislature eliminates the threat of closure and staff lay-offs to
the South Dakota Arts Council, Office of History, State Library and South
Dakota Public Broadcasting. All the above agencies are included in the
budget cuts, however.
Should voters decide to make video lottery constitutional on November 8th,
a pro-rated amount of the cuts will be restored to the agencies' budgets.
Travel restrictions continue to apply to all state government workers.
South Dakotans for the Arts with grassroots support, continues to educate
legislators and gubernatorial candidates as to the value of the agency and
will work toward restoring all funds for FY96 and increasing the agency's
budget to represent $1 per person in South Dakota.

CANADIAN COMPOSER MARTIN BARTLETT DIES
Canadian composer Martin Bartlett died of AIDS-related illness on Sunday
August 22 at his home in Vancouver, BC. Bartlett taught at Simon Fraser
University in Burnaby and composed electro-acoustic music using just tuning
systems. His travels in Asia led to his establishment of Gamelan Kia Madasurai
at SFU. He helped to establish the Western Front, an alternative space, which
has played a large role in new music in Canada. An essay by
composer/performer George Lewis has been posted as an assessment of
Barlett's contributions to the field.

VERY SERIOUS AND VERY REAL: MISSING PERSON
Arts Wire user Alan Millar, former director of The LAB in San Francisco,
reports that his sister-in-law disappeared on August 22, 1994. Millar,
family and friends are conducting a widespread search including an active
investigation employing the Internet; a $25,000 reward has been posted.
Millar's sister-in-law's name is Kimberly Nilson. She is 24 years old,
5'5", thin, muscular, tanned, blue-eyed with dark blond hair that falls
below her shoulders. She is an amateur athlete and an Arizona State
Pre-Med student. She may have been seen by her roommate at home asleep at
6:30 am Monday morning 8/22/94; she was to have met a friend at home before
9:00 am on the first day of classes at ASU. She did not answer the door.
Her home is at the Meridian Corners Apartments, 1500 Broadway, Bldg. 35,
between McLintock and Rural in Tempe, AZ. Her car, a black 1982 Volkswagen
Rabbit with dark tinted windows, a yin/yang symbol sticker on the front
windshield, and a radio station sticker on the back window, was found
abandoned with the keys in the ignition, her driver's license and checkbook
inside, at the corner of North 92nd Way and Palm Tree, in a remote
subdivision of Pima Road in North Scottsdale, AZ. It may have been driven
North along Pima Road sometime before 8:40 am, and it may have needed gas
somewhere between Tempe and Scottsdale. It may have been driven by someone
else, and it may have been accompanied by another car. She had won first
place in her age group in the triathlon in Flagstaff on Sunday, August 7th
and she had just been informed by her counselor that she would graduate a
semester early and have her degree by December. There is no reason to
believe she would have walked away or disappeared without talking to her
family and friends. It is believed she is in trouble. Call the Tempe
Police Department at 602-350-8311 if you have any information that may lead

Ministry is being administered by the Reverend Lee Meyer on the behalf of
her family; funds to support this search may be sent to Bank One Account

REMINDER: OCTOBER IS NATIONAL ARTS AND HUMANITIES MONTH
In 1993 cultural organizations, agencies and institutions, artists,
scholars, President Clinton, 45 governors, over 300 mayors and the American
public participated in the first National Arts and Humanities Month.
Hundreds of individuals across the country volunteered their time to bring
attention to the importance of the arts and the humanities in their
communities. Over 550 print and broadcast media stories were generated
about NAHM both nationally and in every state. NCA's 1994 National Arts
and Humanities Month will be a nation- wide celebration of the arts and the
humanities building on the successes of 1993. National Arts and
Humanities Month (NAHM) is one element of the first multi-year national
public awareness campaign for the humanities and the arts. Coordinated by
the National Cultural Alliance (NCA: 202-289-8286), the effort includes an
Advertising Council public service advertising campaign and national public
relations campaign.

LITTORAL: NEW ZONES FOR CRITICAL ART PRACTICE
As part of a conference called LITTORAL: New Zones for Critical Art
Practice, two hundred artists, students and critics who work with poverty
groups, ecology issues, media and minority concerns gathered this past weekend
at Salford University in England to discuss various artist-initiated explorations in
the social sphere. Central to the discussion was the idea that rather than
comment on actual issues, artists are beginning to act directly in the
social realm. On-line interaction with Arts Wire users was encouraged.
